COVID-19 WARNING, ASSUMPTION OF RISK, WAIVER OF RISK AND RELEASE OF LIABILITY AND INDEMNIFICATION FOR ATTENDING TO 2022 NATIONAL ASSOCIATION OF BROADCASTERS (NAB) SHOW
- WARNING RELATED TO COVID-19 INFECTION
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious.
The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease.
The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19.
Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
It is not possible for NAB to prevent against the presence of the disease; and therefore, if you choose to attend the NAB Show you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. COVID-19 infection may result in personal injury, illness, permanent disability, and death.
NAB cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending the NAB Show.
The risk of becoming exposed to or infected by COVID-19 while attending the NAB Show may result from the actions, omissions, or negligence of you and others, including, but not limited to, NAB employees, volunteers, and NAB Show attendees, [list as appropriate] and their employees.
- ASSUMPTION OF RISK
I have read and understood the above warning concerning COVID-19. Attending the NAB Show is of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend the NAB Show, and I hereby declare that I choose to accept the risk of contracting COVID-19 and I agree that I am personally responsible for my safety and actions while attending the NAB Show.
- WAIVER OF LAWSUIT/ RELEASE OF LIABILITY:
With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue NAB its board members, officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party attending the NAB Show, or otherwise, while participating in any activity while in, on, or around the NAB Show and/or while using any facilities, tools, equipment, or materials.
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my attendance to the NAB Show or use of any facilities, tools, equipment, or materials related to the NAB Show, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

NAB Show has a zero-tolerance policy regarding “suitcasing”. All marketing and promotion must remain within the contracted exhibit space. Show Management reserves the right to remove individuals or discard display materials that do not comply with these guidelines.
